Commission Contract
Many artists at some point in their career are asked to
create designs and art work for clients. An artist might
be asked to create a design to be reproduced on T-shirts,
carpets, a dinner service or they might be asked to create
an original art work for display in an office lobby or
board room.
A contract for commission is used when an artist is asked
to create a new work. Before they start the artists should
understand what sort of work is expected, how long they
have to finish it and what the work is for. An artists
should also understand how much money they will be paid
and when.
In most cases this type of agreement can be straight forward.
The client usually knows what type of work is to be expected
from the artist and the fees are usually discussed before
the work commences.
In other cases there can be difficulties in coming to
agreement about the commission.
Sometimes the client decides they do not like the work
or unexpected expenses blow out budgets. In other cases
the artist has trouble completing the work in the time
set. For these reasons it is important to have a contract
which states clearly the rights of the client and the artist.
This contract model offers a number of alternatives. It
should be read carefully by both parties and only the relevant
clauses should be included.
There is no reason for the artist to assign copyright
in this type of contract.
